Midwest Auto Auction Policies
| Midwest Auto Auction is a dealer’s only auction. NO RETAIL BUYERS ARE ALLOWED ON THE PREMISES. Anyone who is not a dealer or dealer employee MUST stay in lunchroom area. | |
| All dealers must be registered at this auction before performing any transactions | |
| No children are allowed on the auction premises. | |
| All vehicles purchased must be paid for through the auction office on the day of the sale or a $25 fee will be assessed for each vehicle. | |
| All vehicles must be paid for with a company check or cash | |
| All title-attached vehicles must be paid for with a separate check. | |
| All consigned vehicles must be run through the auction block. Any outside or off the block sale must be consummated through the auction office. All such sales are as-is. | |
| Vehicles that are deemed unsafe to operate will not be run through the auction lanes. | |
| Vehicles left on the Auction premises are at the owner’s request and risk. Midwest Auto Auction assumes no responsibility for loss, damage or theft of any vehicle or its contents, on the auction premises. All vehicles must have the keys left in them. | |
| Changes in dealer registration information such as ownership, authorized buyers, bank etc., must be reported to Midwest Auto Auction in writing. | |
| All vehicles are subject to search before leaving the premises. | |
| Midwest Auto Auction reserves the right to void any transaction |
| All titles submitted by seller must be in seller’s company name on the title or reassignment form. | |
| All out of state titles must be announced. If not announced, buyer may reject the vehicle (Wisconsin Statute Administrative rule trans. 138.05) | |
| TITLE ATTACHED SALES ARE STRONGLY DISCOURAGED! | |
| ALL TITLE ATTACHED VEHICLES MUST BE ANNOUNCED! Failure to announce T/A vehicle is grounds for rejection. | |
| All titles and reassignment on consigned vehicles should be turned in to the auction office when the vehicle is checked in. Announce to the auctioneer that the title is on the premises. If a negotiable title is not turned in to the auction office by the end of business on auction day, that vehicle will be considered title attached. All T/A transactions are subject to $10.00 fee. | |
| TITLE ATTACHED TRANSACIOTNS. Seller has up to seven days from the day of the sale to provide auction with a negotiable title. Buyer should not sell, drive excessive miles or spend any additional money on a T/A vehicle until he receives a negotiable title. Midwest Auto Auction WILL NOT BE RESPONSIBLE for any additional costs (beyond purchase price) the buyer may incur on title attached sales. | |
| ALL BRANDED TITLES MUST BE ANNOUNCED! This includes any salvage or insurance branded titles. Failure to announce a branded title is grounds for rejection. | |
| ALL CERTIFICATE OF ORIGIN sales must be announced. Only franchised dealers may sell with Certificate of Origin. Buyer and seller must sign a special release form. The auction will not be responsible for any sales tax consequences in Wisconsin or any other state. | |
| Midwest Auto Auction operates under the laws of the State of Wisconsin. The auction will furnish you with a title that is negotiable under Wisconsin law. The auction will not be responsible for titles that may not be negotiable in any other state. | |
| All titles with the following defects will not be accepted. Erasures, alterations, wrong digits or descriptions, improper reassignments, out of state affidavits of repossession, titles from foreign countries, photocopies of reassignments or lien releases or power of attorney. | |
| Unsigned involuntary repossession titles cannot be transferred in Wisconsin. Clear title in repossessor’s name must be furnished before payment for vehicle will be made. | |
| Midwest Auto Auction will not be responsible for transportation or any other expenses of a returned vehicle due to any title problem. |
Seller's Responsibilities:

Please have your units on the auction premises early on sale day or before. Any vehicle arriving after its number has run will be placed at the end of the sale. | |
| Sellers are responsible for correcting any errors made by Midwest Auto Auction in the description or any announcement. Please represent your vehicles fairly and accurately. | |

SELLER MUST ANNOUNCE THE FOLLOWING ITEMS:

| Seller must announce any vehicle with FRAME DAMAGE whether damage has been repaired or not. Buyer has the right to reject or arbitrate frame damage within five working days following the sale. When a buyer reports frame damage to the auction, the auction will notify the seller and stop payment on the check to the seller if one has been issued. The transaction will be treated as a title attached transaction until the dispute is resolved. Undercarriage damage from normal use (scratches, scrapes, jack or lift marks, minor pinch weld damage, minor corner tie down marks not resulting from an accident) are NOT grounds for rejection. | |
| Sellers are responsible for insuring the vehicle at the auction and during transport to the auction | |
| Please see that each vehicle has an adequate amount of fuel while at the auction | |

Any vehicle not sold must be entered in to the next sale, or removed by the fourth working day after the sale. All vehicles not removed will be charged $25 storage per week or any part of a week. Any vehicle left more than 4 weeks will be towed at owner’s expense. |
Buyer’s Responsibilities
| Use care in examining vehicles prior to the sale. It is your responsibility to be familiar with all announced conditions. | |
| Check the VIN plate and odometer before leaving the sale. | |
| Obvious damage such as glass and body damage are not arbitratible | |
| Spare tires are the buyer’s responsibility. | |
| Make sure you have cash or a company check to pay for your purchases ON THE DAY OF THE SALE. | |
| Buyer must be authorized by dealer, in writing, to sign checks, prior to the sale. | |
| Buyer assumes responsibility for mechanical failure or damage after leaving the sale. | |

All sold vehicles not removed by the fourth working day after the sale will be charged storage of $25 per week or any part of a week. Any vehicle left more than 4 weeks will be towed at owner’s expense. | |
| Buyer is responsible for body damage to a vehicle while he is test driving it. | |
|
A blue light above the auctioneer means there is an announcement on the vehicle. If you miss an announcement, ask auction staff before bidding. Announced conditions are not arbitratible. |
Auction Guarantees:
| Auction guarantee applies only to vehicles selling for over $1500. Guarantee covers powertrain, crank, rods, block, transmission rear end and valves within $400 for mechanical defects. | |

| All arbitration must be done on the day of the sale. The next day is too late. | |
| The auction does not guarantee
the model year of any imported vehicle, motor home, house trailer, boat,
boat motor, antique vehicle, kit car or dune buggy. Buyer is responsible
for verifying the year of any such vehicle. | |
| Except for frame damage, all
arbitration and rejections must be handled through the auction within one
hour of purchase on sale day. The auction will not become involved in any
subsequent dispute. After any accepted adjustment, the sale is treated as
an “as-is” sale is not eligible for any additional
arbitration. | |
| If arbitration cannot be
resolved, the seller will retain ownership of the vehicle. Midwest Auto
Auction is not obligated to pay for any vehicle for any
reason. | |
| Frame damage must be reported to the auction within five business days to be arbitrated. | |
| In the case of any dispute, THE
DECISION OF THE ARBITRATOR IS FINAL. | |
| The seller may put an auction
guarantee on any vehicle not otherwise covered. However, should such a
vehicle be arbitrated and rejected, the seller is still liable for any
auction sale fees. | |
| Midwest Auto Auction reserved
the right to change or modify its policies without
notice. | |
| All vehicles registered at this
auction are subject to inspection by the FBI, state or local police or
National Auto Theft Bureau. If any vehicle is impounded by authorities,
the seller will not receive a check. If a check has already been issued, a
stop payment will be issued. | |
| Remember, you alone are responsible for your employees while on the auction grounds. Your workman’s comp must cover you and your employees. In case of injury, Midwest Auto Auction assumes no responsibility. | |
| “If sales” are binding on the
buyer until the end of the sale business day. If the seller agrees on the
price of the vehicle before the end of the sale day, the buyer is
obligated to purchase the vehicle. If you are selling a vehicle on an
“if”, make sure the auction has a good contact number for you during the
sale day. After the end of the sale day, if the auction cannot reach the
seller, the sale becomes a two way if. | |
| If you cannot have a person
present to represent a vehicle on sale day, please give the office a
protected price. The best way to handle “IF” sales is to avoid them
whenever possible. | |
| The auction does not guarantee manufacturer’s warranties or any vehicle’s eligibility for any warranty. Midwest Auto Auction reserves the right to revoke a gate release or deny admission to anyone for just cause at the auctions discretion. | |
| To avoid a no show fee, please notify us of cancellations by Monday night. No show fee is $25. | |
| Midwest Auto Auction will not sell any gray market vehicles | |
| Returned check fee is $50. |
